We all are equally frustrated with the situation we are in. We can always find reasons to fight within our community (EB Vs FB, Legal Vs Illegal, EB1 vs EB2 Vs EB3 - the list is endless). These outburst of frustrations / arguments and counter arguments do not take us anywhere.
Let us keep supporting IV and build a strong partnership of interested parties. Let us focus on areas where we can agree. Many among us worked hard to build this community, let us try to strengthen and preserve it.

at some month before OCT 2007 the dates would become unavailable.
what would happen at that time?
say your case was received by USCIS and they have not issued FP notices.
what if they issued FP notices but not issued EAD and/or AP.
would they still issue an EAD and AP even if your dates are not current(obviously the case was received by them and they issued you a case number)
any ideas?
In that case people with PD 2002 2003 whould have not got EAD's or renewals.. it won't affect the people who filed.
Once you file 485 ,PD will stop only getting you GC.

Folks, I am preparing a draft of the letter to be sent to the media. Any suggestions for points to be included are welcome!
I plan to include some information about the immigration system, details about the fiasco, how it impacted us, what our flowers are meant for.

Mehul, After reading your post, I feel very bad for what you are going through and my heart goes out to you and your family. I know nothing of what I say is enough to help you but again, I still say it with the hope that things will turn around for you. GOD HAS HIS WAYS, AND HE IS THE ULTIMATE FORCE IN THIS WORLD. I have often wondered, the chase we chase. The reality is nothing else matters but HIM yet it is so difficult to accept this reality and we chase the materialistic things in him which at the end, every one of us writing here and reading is going to leave behind one day.
GOD IS KIND, HE WILL LOOK AFTER YOU. PRAY TO HIM, SINCERELY. I suggest you take all the treatments there is and Don't worry you will come out of this. He will protect you and many prayers come your way. I will definitely pray for you and your family.
Nothing else matters. As per your question, I think consulting your lawyer and then working with him to meet a senator or congressmen to help expedite your case may prove helpful. Both of you can work together so you have a backing. And like someone earlier posts said, make sure your finances are strong and have a family backing in US.

Another thing i have found out here among many groups of indians here is that they are trying to do what others are doing in their group so if others are not returning back then there are also not probably returning back.

Filed I-485 on July 31,2007. Checks cashed on Sep 10th and received Receipt Notices for me and my wife through the attorney yesterday. I am in the EB-2 category with PD: Oct 2005.
However, on both of our I-485 receipt notices, the Category shows up as "Unknown" ...Has anyone else faced any such thing...

its not just this employer, many f____ employers have same issue they dont want to file 485 and atleast they are trying to delay the process as much as possible. They are fearing that the employees on L visas will have an oppurtunity to switch company if they get their GCs sooner.

My reaction would have been the same if you were in Eb1 category. The fact is that I am trying to mobilize some people to get few things done. Of course, motivated by my self interest.
I was against SunnySurya's porting agenda and still am. But the current issue he is taking up is a genuine one. There should be a reasonable processing expectation that the earlier the PD the sooner the GC,with all other things (like category)being equal.
However eb3_nepa has a valid point too that you can't expect to utilize core's time/energy.
In my opinion, SunnySurya is going in right direction championing this cause.

You will see a date on I-485 only if you filed I-140 & I-485 concurrently. Even my I-485 does not have any priority date.
Do you have Pritority Date written on your I-485's notice of action? It's blank for me.

I worked with a MNC for 4 yr 10 months at US soil and they ruined my GC saying that they want me more at Offshore (India ).... I got intelligence about this planning about 3 months earlier from a real good friend of mine ... So i arranged a H1B Job with a Desi consulting company in this 3 months and when they asked me to go back To India - you know what finger i've shown them.
Now this desi consulting company kept their words with salary,applied for LC quickly( because my H1 was close to 6 yrs) and i'm with them for 2.5 yrs . Now when i reached them for a employer letter for 485 they changed colors and asked me to sign a 10K bond for staying with them 1 year after GC ( which is an indeterminate period given retrogression)
Which employer would you call better ?? :)

Unless and untill everybody in EB3 has contributed ataleast a $1000.00 to the immigrationvoice cause, its waste of time to discuss about the EB3-India movement. Any way we have to spend a lot more than $1000.00 in renewing EADs, H1Bs and H4s.
Otherwise just wait and pray for the CIR bill to pass. Then every body in the EB category will get the benefit being the EB3- India/China are the greatest benefitters.
How can contributing $1000.00 to immigration voice solves this problem? You are telling like a swami's in India, give me money I will do some pooja on your behalf and all your problems will be solved.

I sent my 485 to NSC on JUL 2nd, my 140 approved TSC, no receipts . Does any body got receipts who applied on JUL nd...?

I am starting this new thread to discuss about EB visas spillover usage based on oldest priority date irrespective of category/country. Currently the spillover happens vertically(a top down approach) from EB1 -> EB2 -> EB3...etc. Instead it should be first used on cases with oldest priority date. This will not only give a good move to clear the backlog but will also be a fair rule for those who are patiently waiting in queue for a long time. I wrote my concern about this to my local congressman. I also request each one of you, who is impacted by this, or who is interested to help us out, to kindly contact your local congressman/woman to express your concern. In turn they can contact USCIS to implement this fair rule to help us all out.
If this idea is implemented, a Pulitzer or Oscar or Olympic Medal winner(let us say in 2010) will have to wait until all backlog before his/her PD is cleared.
